Durango Tool Library

1. Members must be 18 years old or older to borrow and use tools from the Durango Tool Library.
2. Prior to borrowing tools, all Members must (a) submit an application by creating a user account and selecting a membership subscription; (b) sign the Member Waiver of Indemnification form; and (c) have their identity and residence confirmed by a DTL staff member. The first two steps can be completed online or in-person. For step (c), visit the Durango Tool Library in-person and present a valid government issued photo ID.
3. DTL staff may be available to assist in explaining the operation of tools. However, by taking possession of any item, the Member is certifying that he or she is capable of using that item in a safe and proper manner.
4. Only the Member is authorized to use DTL tools. The Member shall not permit the use of items checked out to them by any other person unless by the express permission of DTL and that user has signed our Waiver of Indemnification.
5. Members are not authorized to use DTL tools for commercial or contractor services. DTL tools are not intended to support extended for-profit use.
6. Members will not specifically be charged for borrowing any tool unless it is returned in a state that indicates severe neglect and misuse by the Borrower.
7. All tools borrowed are to be returned to the DTL by close of business on their due date. Tools may be returned before or on their due date during DTL business hours.
8. If a tool is returned late, the Member will be responsible for late fees. Late fees are $3/tool/day and capped at the value of the tool(s) plus a $10 administrative fee per tool. If a tool is 21 days late, the Member is given 1 additional week to return/replace tools or their membership is permanently revoked. DTL may replace severely delinquent tools, holding the Member responsible for the full replacement cost—current market price, taxes, and shipping for replacement, as applicable—plus the $10 administrative fee. Fines must be paid in full before borrowing additional items.
9. DTL reserves the right to use appropriate steps to retrieve delinquent tools or unpaid fines and fees, including the use of a collection agency and/or legal action. The Member will be responsible for all associated costs of such. DTL also reserves the right to forgive fees due to special circumstances.
10. The Member agrees that DTL is not responsible for any manufacturing defects in quality of workmanship or materials inherent in any borrowed tools.
11. The Member agrees that if any borrowed tool becomes unsafe or in a state of disrepair, they must immediately discontinue use of the tool and notify DTL by the return date.
12. All tools are to be returned in the same or better condition as they were issued, barring normal wear and tear. All tools must be returned clean. The Member agrees to pay for the loss or damage of any item and further agrees to accept DTL’s assessment of condition of items and to further agree to DTL’s assessment of fair restitution for damage, dirtiness, delinquency, and/or loss of items in part or in total.  This restitution amount could equal the full replacement cost of the item plus the $10 administrative fee.
13. DTL reserves the right to refuse the loan of any item at its discretion.

I affirm that the information that I have provided on the Membership Application is current, true, and correct and that this information is subject to verification.

I have read and fully understand the rules and regulations of the Durango Tool Library, and that failure to comply with any of these rules may result in revocation of my borrowing privileges and/or legal action against me.

I have read and accepted the Waiver of Indemnification form, relinquishing any and all claims against the Durango Tool Library.

The tools in our collection are for the use of Durango Tool Library members. Out of respect for future users, please clean any tools you borrow before returning them and report any damage to the Tool Library immediately. Borrowers are responsible for damage that they have caused.

I state that I am capable of using the tools I am borrowing, and that I will use the tools I am borrowing in a proper manner.

I, do hereby for myself, on behalf of my successors and assigns, in consideration of being permitted to borrow tools, waive any and all claims against the Durango Tool Library, its officers, agents, and employees for any injury or injuries of any nature that I may suffer or incur in the use of the tools that I am borrowing from the Durango Tool Library.

I, do hereby for myself, on behalf of my successors and assigns, in consideration of being permitted to borrow tools, agree to release and indemnify and hold harmless the Durango Tool Library, its officers, agents, and employees from any and all liability, loss, claims, and demands, actions or causes of action for the death or injury to any persons and for any property damage suffered or incurred by any person which arises or may arise or be occasioned in any way from the use of tools I am borrowing from the Durango Tool Library. I am aware that Durango Tool Library, its partners, directors, officers, members, and employees claim no expertise and make no representation concerning the fitness of any tool for any particular use.

I affirm that the above information is current, true and correct and may be subject to verification. I further state that I have read and fully understand the Durango Tool Library Borrowing & Tool Use policy, rules, and regulations, and I understand that failure to comply with any of these rules may result in revocation of my borrowing privileges and/or legal action against me. 

I have read this Waiver of Indemnification, relinquishing any and all claims against the Durango Tool Library, its officers, agents, and employees.
